What is an Expert Witness Engineer, and how do they help you create a Successful Legal Case

An expert witness is a special type of witness who does not need to have actually witnessed the accident, crime, or event. Collectively I will call these; an incident. An expert witness needs to have special qualifications and experience which enables them to evaluate all the available evidence and form an expert opinion on matters that are critical to the case. These opinions are provided to the court in the form of a written report, and if required, in person testimony. 

Expert witnesses must follow a code of conduct and their duty is to the Court. They can be appointed as a joint expert by all parties in a case, or by individual parties. When multiple expert witnesses, in a particular field, are appointed by different parties in a matter, the experts will typically review each other’s reports. Where there is disagreement amongst the experts, the court can instruct that they meet to discuss the matters and provide a joint report.   

My experience is as an expert witness forensic mechanical engineer.  I have investigated more than 500 incidents over the last 25 years and use my experience in mechanical engineering to provide valuable technical expertise and analysis in matters within my field of expertise. Using my experience, I help lawyers and judges better understand the technical aspects of the case and also provide expert opinion on matters in dispute. 

My experience as an expert witness mechanical engineer includes cases involving motor vehicle accident investigation and reconstruction, major industrial accidents, machinery failure, workplace injuries, patents & copyright disputes, personal injury, machinery fires, aircraft crashes, and product liability claims.

As well as providing expert reports for the Federal Court of Australia, Federal Circuit Court of Australia, Supreme Courts, Magistrates Courts, District Courts and the High Court of New Zealand, I have appeared to give evidence in Supreme Courts, District Courts, and Magistrates Courts in Australia. Matters for which I have presented evidence to the Court in person include cases involving charges of manslaughter; dangerous operation of a motor vehicle causing death; machinery fit for purpose matters, class actions, and various civil matters. 

Noteworthy cases include Parliament House, Canberra, where I inspected and analysed the cause of approximately one million dollars’ worth of damage to the Cabinet Room and the Prime Minister’s office, a crane failure that led to the destruction of the crane and major damage to a mining dragline boom, failure analysis, including Finite Element Analysis, of failed parts from a nuclear reactor in a nuclear medicine facility, and providing expert evidence for one of the big Japanese Motor vehicle companies regarding an intellectual property dispute over a system in their electric vehicles.

This is especially important in cases where emotions run high, and where there are conflicting accounts of what happened, or opinions as to why it happened.
